These Terms of Use ("Terms") govern your use of the website plugins.lutzcreativegroup.com (the "Site") and the WordPress plugins made available by Lutz Creative Group, LLC ("LCG Plugins," "we," "us"), including ACF Divi Panel (each, a "Plugin"). By using the Site or installing a Plugin, you agree to these Terms.

1. Purchases and refunds

Plugins are sold through the Divi Marketplace operated by Elegant Themes, Inc. Purchases are subject to Elegant Themes' terms of service and refund policy (currently a 30-day money-back guarantee), which govern the transaction itself. These Terms govern your use of the Plugin and this Site.

2. License

Our Plugins are licensed under the GNU General Public License, version 2 or later (GPL). The GPL gives you broad rights to use, modify, and redistribute the code. Your purchase additionally entitles you to one year of updates and support per license, per the Divi Marketplace's licensing structure. Product names, logos, and branding — including "ACF Divi Panel," "LCG Plugins," and "Lutz Creative Group" — are our trademarks and are not licensed under the GPL; you may not use them to market derivative products.

3. Support and updates

Active licenses include support and updates for one year from purchase. Support covers the Plugin's own functionality on configurations meeting its stated requirements. It does not cover general website development, customization of your site, conflicts caused by third-party software, or versions of Divi, ACF, WordPress, or PHP below the Plugin's stated requirements. Plugins continue to function after a license expires, but updates, downloads, and support require an active license.

4. Your responsibilities

You are responsible for your own website, including: maintaining complete backups before installing or updating any software (ours included); keeping WordPress, themes, and plugins updated; testing changes on a staging environment where the site is business-critical; and securing your own hosting, accounts, and credentials. Software interacts unpredictably with the endless variety of hosting environments and plugin combinations — backups are your safety net, and maintaining them is a condition of using our Plugins sensibly.

5. Acceptable use of the Site

You agree not to misuse the Site — including attempting to breach its security, scraping it at disruptive volume, or using it to distribute malware or unlawful content.

6. Disclaimer of warranties

THE SITE AND THE PLUGINS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLUGINS WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLUGINS ARE FREE OF VULNERABILITIES OR WILL BE COMPATIBLE WITH ANY PARTICULAR CONFIGURATION OF WORDPRESS, THEMES, PLUGINS, OR HOSTING. NO ADVICE OR INFORMATION OBTAINED FROM US SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN. (This section is consistent with the warranty disclaimer in the GPL under which the Plugins are licensed.)

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LUTZ CREATIVE GROUP, LLC, ITS MEMBERS, OFFICERS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, OR THE COST OF SUBSTITUTE SERVICES — ARISING OUT OF OR RELATING TO THE SITE OR ANY PLUGIN, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR COMPROMISE OF YOUR WEBSITE, WHETHER OR NOT A PLUGIN IS ALLEGED TO HAVE BEEN A FACTOR.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR ANY PLUGIN SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PLUGIN LICENSE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN SUCH CASES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

8. Indemnification

You agree to indemnify and hold harmless Lutz Creative Group, LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Site or a Plugin in violation of these Terms or of applicable law.

9. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date reflects the current version; continued use of the Site or Plugins after changes take effect constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in [COUNTY], Florida, and you consent to their jurisdiction.
